Terms of Service

1. Agreement to These Terms

These Terms of Service (the "Terms") form a binding agreement between Questoria Play ("Questoria Play," "we," "us," or "our") and every person or organization that visits our website, requests a proposal, confirms a booking, purchases a service, attends an activity, or otherwise interacts with our recreational entertainment services (the "Client," "participant," "you," or "your").

By using the website, submitting booking information, approving a proposal, paying an invoice, or participating in a scheduled activity, you confirm that you have read, understood, and agreed to these Terms. If a booking is made for a group, the individual or organization arranging the booking represents that it has authority to accept these Terms for the booking and will provide relevant rules, safety information, and participation requirements to all attendees.

If you do not agree with these Terms, you must not purchase, book, or participate in our services. A separate written proposal, statement of work, booking confirmation, or service agreement may contain additional terms. If an expressly stated provision in a signed service agreement conflicts with these Terms, the signed provision controls only for that booking and only to the extent of the conflict.

2. Nature and Scope of Services

Questoria Play provides recreational game facilitation and event activity services. Our work is entertainment-focused and may include guided group play, team challenges, custom scenarios, themed quests, intellectual puzzles, narrative materials, and coordination of game-based programs for private or organizational events.

  • Guided Recreational Game Sessions, including rule explanation, participant support, pacing, and facilitation
  • Team Challenge Activities built around collaborative tasks, puzzles, communication, and shared problem solving
  • Interactive Scenario Development, including original stories, themes, characters, clue systems, activity materials, and event structures
  • Event Game Coordination, including selection, sequencing, setup, facilitation, and supervision of agreed recreational activities

Our services do not include gambling, betting, lotteries, games of chance for money or valuable prizes, casino operations, wagering platforms, or regulated gaming activity. Unless specifically stated in a written booking document, our services also do not include professional counseling, psychological assessment, accredited training, security services, childcare, medical supervision, or venue management.

Descriptions, photographs, sample scenarios, schedules, and estimates shown on the website are illustrative. The exact content, duration, staffing, venue requirements, participant capacity, and deliverables for a booking are established in the applicable proposal or written confirmation.

3. Eligibility and Authority

You must be at least eighteen years old and legally capable of entering into a contract to make a booking. A person arranging services on behalf of a company, school, association, venue, household, or other group confirms that the person has authority to bind that client to the agreed booking terms and payment obligations.

Participants under eighteen may attend only when the activity has been approved for their age group and a parent, legal guardian, school representative, or other responsible adult has provided any required consent and supervision. Questoria Play may establish minimum age requirements for particular scenarios based on complexity, subject matter, venue conditions, props, or physical demands.

We may refuse or discontinue participation when age, capacity, conduct, intoxication, safety, accessibility, or other circumstances make participation unsuitable or unsafe. Such decisions are made to protect the group, staff, venue, and property and are not a guarantee that every risk can be identified or eliminated.

4. Inquiries, Proposals, and Booking Confirmation

An inquiry, estimate, website submission, telephone discussion, or informal conversation does not reserve a date or create a confirmed booking. Unless otherwise stated in writing, a booking becomes confirmed only after we issue written confirmation and receive the required deposit or full payment.

Proposals may include an expiration date. Availability, personnel, venue access, and quoted pricing are not guaranteed after that date. If material booking information changes after confirmation, including date, location, group size, duration, activity scope, language, accessibility needs, or equipment requirements, we may revise the price, schedule, staffing, or feasibility of the booking.

You are responsible for reviewing every confirmation, invoice, participant limit, address, start time, and service description promptly. Any suspected error must be reported as soon as reasonably possible. We are not responsible for avoidable disruption caused by inaccurate or incomplete information supplied by the Client.

5. Client Information and Cooperation

To prepare and deliver the agreed services, the Client must provide timely, complete, and accurate information. Depending on the booking, requested information may include the participant count and age range, venue address, room dimensions, parking or loading instructions, accessibility needs, desired theme, scheduling restrictions, safety rules, and a reliable on-site contact.

The Client must disclose known conditions that could materially affect delivery, including restricted access, construction, unusual noise limits, venue curfews, security procedures, shared public areas, prohibited materials, or participant needs requiring reasonable planning. Sensitive medical details should be limited to information reasonably necessary for safe participation and should not be submitted through unsecured channels.

Delays, additional work, replacement materials, or rescheduling caused by missing, inaccurate, or late Client information may result in revised timing or additional charges. We will communicate material changes before incurring avoidable additional costs whenever reasonably practical.

6. Prices, Deposits, and Payment

Prices are stated in United States dollars unless the applicable proposal expressly says otherwise. The Client must pay all amounts according to the schedule shown in the proposal, invoice, or booking confirmation. A deposit may be required to reserve the date, begin custom scenario work, purchase materials, or assign staff.

Quoted prices are based on the information and scope available when the quote is prepared. Additional participants, extended time, venue changes, special materials, travel beyond the quoted service area, rush preparation, or work outside the agreed scope may require written approval of an additional fee.

Payment processing, authorization holds, declined transactions, taxes, late payments, disputed charges, and billing corrections are governed in further detail by the Payment & Billing Policy. Cancellations, rescheduling, and refund eligibility are governed by the Cancellation & Refund Policy. Both policies are incorporated into these Terms.

7. Scheduling, Arrival, and Event Timing

The Client must ensure that the venue and required access are available at the agreed setup time. Participants should arrive by the time stated in the booking confirmation. Late arrival may reduce activity time because staff, venue access, subsequent bookings, transportation, or other operational commitments may prevent an extension.

A scheduled duration may include introduction, rule explanation, safety briefing, gameplay, breaks, scoring, discussion, and closing. We may make reasonable changes to activity sequence, pacing, staffing assignments, or individual challenges to respond to group needs, venue conditions, material availability, or safety concerns without changing the essential nature of the purchased service.

Extensions are subject to staff and venue availability and may involve additional fees. Unused time caused by late participants, delayed venue access, missing Client approvals, or interruption by third parties does not automatically create a right to a refund or price reduction.

8. Venue and Site Requirements

When services occur at a location not controlled by Questoria Play, the Client is responsible for securing permission to use the venue and for confirming that the space is appropriate, lawful, accessible, and available for the planned activity. The Client is also responsible for venue fees, permits, security requirements, parking, utilities, furniture, internet access, and other site resources unless they are expressly included in our written scope.

We may pause, adapt, relocate, or cancel an activity if the site contains unsafe conditions, inadequate space, prohibited access, severe weather exposure, aggressive animals, uncontrolled crowds, dangerous equipment, illegal activity, or other conditions that materially interfere with safe delivery. The refund or rescheduling consequences will depend on which party controlled the condition and on the costs already incurred.

The Client is responsible for damage to our props, equipment, costumes, printed materials, or other property caused by intentional conduct, unauthorized use, reckless behavior, or failure to follow instructions by the Client or its participants, excluding ordinary wear and tear.

9. Participant Conduct

All participants must follow facilitator instructions, venue rules, and reasonable safety directions. Participants must treat staff, other guests, property, and the venue with respect. Harassment, threats, violence, discriminatory abuse, deliberate damage, theft, dangerous horseplay, unauthorized recording, or interference with staff is prohibited.

Participants may not bring weapons, illegal substances, or hazardous materials into an activity. A participant who appears materially impaired by alcohol, cannabis, medication, or another substance may be refused entry or removed when impairment creates a safety or operational concern.

We may stop an individual activity or the entire event if prohibited behavior continues after a warning or if immediate action is reasonably necessary. Removal for misconduct does not entitle the responsible participant or Client to a refund. The Client remains responsible for charges, damages, or third-party costs arising from the conduct of its group.

10. Safety, Health, and Accessibility

Some activities may involve standing, walking, reaching, handling lightweight props, navigating dim or decorated spaces, reading small materials, hearing verbal instructions, or working under time pressure. The exact demands vary by scenario. Participants must use their own reasonable judgment and stop immediately if they feel unwell, unsafe, or unable to continue.

Clients and participants should notify us before the event of reasonable accessibility needs that may affect participation. We will make good-faith efforts to adapt activities when feasible, but not every venue, scenario, or third-party location can support every requested modification. We will not require unnecessary medical details, and no representation is made that our staff provide medical care.

In an emergency, participants must follow venue procedures and instructions from emergency personnel. Questoria Play may contact emergency services when reasonably necessary. Additional limitations and participant responsibilities are explained in the Recreational Entertainment Disclaimer, which is incorporated into these Terms.

11. Cancellations, Rescheduling, and Force Majeure

A cancellation or rescheduling request must be submitted using the contact information at the end of these Terms. The time the written request is received determines the applicable cancellation period. Standard eligibility rules, custom-work deductions, third-party costs, processing times, and no-show treatment are described in the Cancellation & Refund Policy and may be supplemented by booking-specific written terms.

Neither party is responsible for failure or delay caused by circumstances beyond reasonable control, including severe weather, wildfire, flood, natural disaster, government order, public emergency, utility failure, transportation shutdown, venue closure, widespread illness, labor disruption, or similar event. The affected party must provide prompt notice and make reasonable efforts to reduce disruption.

When a force majeure event prevents delivery, the parties will first attempt to reschedule or reasonably modify the service. Refunds, credits, and unrecoverable third-party costs will be handled according to the Cancellation & Refund Policy and applicable law.

12. Creative Materials and Intellectual Property

Questoria Play and its licensors retain all ownership rights in pre-existing and newly developed game systems, scripts, stories, characters, clue structures, templates, facilitator guides, artwork, written materials, photographs, branding, methods, and other creative content, except where a signed agreement expressly assigns specified rights.

Payment for a service does not transfer copyright or permit resale, public distribution, publication, recording, commercial reproduction, removal of ownership notices, or creation of derivative products. The Client receives a limited, non-exclusive, non-transferable right to use provided participant materials solely for the booked event or other purpose expressly stated in writing.

Client-provided names, logos, themes, text, images, and other materials remain the Client's property. The Client represents that it has permission to provide and authorize the agreed use of those materials. The Client is responsible for claims arising from materials supplied without sufficient rights or consent.

13. Photographs, Recordings, and Publicity

Questoria Play will not use identifiable Client or participant images for public marketing without appropriate permission. When photography or recording is planned, the booking organizer is responsible for informing participants and collecting any consent required for Client-controlled recording or publication.

Participants may take personal photographs only when permitted by the facilitator and venue. Recording or distributing confidential game solutions, facilitator materials, unreleased scenarios, proprietary scripts, or the private information of other participants is prohibited. We may restrict recording when it disrupts the activity, violates third-party rights, or would reveal protected creative content.

14. Third-Party Services

A booking may involve venues, payment processors, transportation providers, caterers, rental companies, independent contractors, or other third parties. Unless expressly identified as our subcontractor, a third party operates independently and may impose separate rules, fees, waivers, cancellation terms, or privacy practices.

Questoria Play is not responsible for the acts, omissions, availability, or independent services of a third party that the Client selects or contracts with directly. We will use reasonable care when coordinating approved subcontractors, but no third-party service can be guaranteed to be uninterrupted or error-free.

15. Disclaimers and No Guaranteed Outcome

Recreational experiences are subjective. Enjoyment, group engagement, puzzle completion, team performance, learning, morale, communication, and event outcomes depend on many factors outside our control. We do not guarantee that every participant will enjoy every theme, complete every challenge, reach a particular score, improve workplace performance, or achieve any other specific result.

To the fullest extent permitted by law, the website and services are provided on an "as available" basis. We do not make warranties beyond those expressly stated in a signed agreement. Nothing in these Terms excludes any warranty, remedy, or consumer right that cannot lawfully be excluded.

16. Limitation of Liability

To the fullest extent permitted by applicable law, Questoria Play will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss, including lost profits, lost business opportunity, reputational loss, or loss of data, arising from the website or services.

To the fullest extent permitted by law, our aggregate liability arising from a particular booking will not exceed the amount actually paid to Questoria Play for that booking. This limitation does not apply to liability that cannot lawfully be limited, including liability to the extent caused by fraud, willful misconduct, or another category that applicable law prohibits us from excluding.

The Client must take reasonable steps to prevent and reduce foreseeable loss. Any concern regarding performance should be reported promptly so that we have a fair opportunity to investigate and, where appropriate, correct the issue.

17. Indemnification

To the extent permitted by law, a Client booking on behalf of a business or organization agrees to defend, indemnify, and hold harmless Questoria Play and its personnel from third-party claims, damages, and reasonable expenses arising from the Client's unauthorized materials, breach of these Terms, violation of law, venue conditions controlled by the Client, or intentional or reckless conduct of the Client's participants.

This obligation does not require the Client to indemnify Questoria Play for claims to the extent caused by Questoria Play's own negligence, willful misconduct, or violation of law. We will provide reasonable notice of a covered claim and allow appropriate participation in the defense and settlement process.

18. Complaints and Dispute Resolution

If a concern arises, please contact us promptly with the booking name, event date, invoice number, a description of the issue, and the resolution requested. We will review available records and respond in good faith. The parties agree to attempt informal resolution before filing a claim, unless immediate action is required to preserve a legal right or obtain emergency relief.

Nothing in these Terms prevents a consumer from contacting a payment provider, regulator, law enforcement authority, consumer protection agency, or court where the consumer has a lawful right to do so. A Client should not initiate a chargeback for a matter that has already been refunded or without providing accurate information to the payment provider.

19. Governing Law and Venue

These Terms and disputes arising from them are governed by the laws of the State of Colorado, without regard to conflict-of-law principles, except where mandatory consumer law requires otherwise. Subject to any non-waivable right to bring a claim elsewhere, proceedings relating to these Terms will be brought in a court of competent jurisdiction serving Colorado Springs, Colorado.

20. Changes to Services or Terms

We may update the website, service descriptions, and these Terms to reflect operational, legal, or business changes. Revised Terms apply from the date posted and do not retroactively alter the price or material scope of a previously confirmed booking unless the parties agree in writing or a change is required by law.

The Terms in effect when a booking is confirmed generally govern that booking. Continued website use after an update constitutes acceptance of the revised website terms, but material changes to an existing confirmed service will be communicated separately where appropriate.

21. General Provisions

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect, and the affected provision will be interpreted as closely as legally possible to its intended purpose. A failure to enforce a provision is not a waiver. The Client may not assign a confirmed booking or its rights under these Terms without our prior written approval.

Section headings are for convenience only. Words such as "including" are illustrative and not limiting. Provisions that by their nature should continue after service completion, including payment, intellectual property, disclaimers, limitations of liability, indemnification, and dispute provisions, survive termination or completion.
